If you are an individual residing in the U.S. whose Private Information was compromised in the Data Breach discovered by McPherson Hospital in July 2022, a class action settlement may affect your rights.
A proposed Settlement has been reached in a class action lawsuit against McPherson, captioned In re McPherson Hospital Data Security Incident Litigation, Case No. MP-2023-cv-000042, in the McPherson County District Court in the Ninth Judicial District of Kansas.
If you are a member of the Settlement Class, you have the following options:

Submit a Claim by January 29, 2025 | You must submit a valid claim form to receive credit-monitoring services from the Settlement and reimbursement for unreimbursed expenses. You can submit a claim online here. |
Do Nothing | You will receive no benefits from the Settlement and will no longer be able to sue the Released Parties, including McPherson over the claims resolved in the Settlement. |
Exclude Yourself from the Settlement by December 30, 2024 | You will receive no benefits from the Settlement, but you will retain your legal claims against the Released Parties. |
Object by December 30, 2024 | Write to the Court about why you do not like the Settlement. You must remain in the Settlement Class to object to the Settlement. |
Go to a Hearing on February 5, 2025 | Ask to speak in Court about the fairness of the Settlement. |
No payments or other settlement benefits will be issued until after the Court gives final approval to the Settlement and any appeals are resolved. Please review the Notice carefully.
